We operate exclusively in accordance with the Allgemeine Deutsche Spediteurbedingungen 2017 – ADSp 2017 – (German Freight Forwarders‘ General Terms and Conditions 2017) and – provided these do not apply for logistic services – in accordance with Logistik-Allgemeine Geschäftsbedingungen 2019 – Logistik-AGB 2019 – (General Terms and Conditions of Logistics-Services Providers 2019).

NOTE: In clause 23 the ADSp 2017 deviates from the statutory liability limitation in section 431 German Commercial Code (HGB) by limiting the liability for multimodal transportation with the involvement of sea carriage and an unknown damage location to 2 SDR/kg and, for the rest, the customary liability limitation of 8,33SDR/kg additionally to Euro 1,25 million per damage claim and Euro 2,5 million per damage event, but not less than 2 SDR/kg.

All agreements and offers are based on ADSp 2017, which are published on our homepage; ADSp 2017 are accepted upon placement of order. Differing or supplementary terms and conditions of the contracting entity, which Robert Kukla GmbH, Munich has not expressly acknowledged in writing, are not binding, even if Robert Kukla GmbH, Munich does not expressly object to them.

All disputes, controversies and claims are governed by German Law and the exclusive place of jurisdiction is Munich. In case that due to mandatory regulations the agreement of an exclusive place of jurisdiction is not allowed the place of jurisdiction mentioned in the preceding sentence is to be seen as an additional place of jurisdiction. Notwithstanding any mandatory international law all disputes, controversies and claims are governed by German Law.

Even in the priority application of the CMR conditions the ADSp applies always in addition.

The CMR conditions apply and otherwise exclusively German law, each as amended.

For our transport orders to you, additional validity of ADSp/AÖSp is expressly excluded.

Furthermore, your General Terms and Conditions shall only be valid in relations with us if we have explicitly acknowledged these in written form.
